1. Acceptance of Terms

By accessing or using the Southwest CRM Partners website (swcrmpartners.com) and CRM software platform (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Services.

2. Description of Services

Southwest CRM Partners provides cloud-based customer relationship management software designed for small businesses. Our Services include the web application, mobile applications, APIs, and related support and documentation.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 16 years of age to use the Services.

4. Subscription Plans and Billing

  • Our Services are offered on a subscription basis with monthly or annual billing cycles.
  • Prices are listed on our website and may change with at least 60 days’ notice to existing customers.
  • All fees are non-refundable except as required by applicable law.
  • Free trial periods provide full access and do not require a credit card. Trials convert to paid subscriptions only with your explicit action.

5. Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • Monthly subscriptions end at the close of the current billing period.
  • Annual subscriptions end at the close of the annual term.
  • You retain access to your account and data until the end of the paid period.
  • You may export your data at any time before your account is closed.
  • After the paid period ends, your data will be retained for 90 days and then permanently deleted.

6. Your Data

  • Ownership: You retain full ownership of all data you upload, enter, or generate through the Services (“Customer Data”).
  • License: You grant us a limited license to use your Customer Data solely to provide and improve the Services.
  • Export: You may export a complete copy of your Customer Data at any time from your account settings.
  • No selling: We will never sell your Customer Data to third parties.

7. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party rights.
  • Send spam, unsolicited messages, or bulk communications in violation of applicable laws.
  • Upload malicious code, viruses, or any harmful content.
  • Attempt to gain unauthorized access to our systems or other users’ accounts.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Reverse engineer, decompile, or disassemble any part of the Services.

8. Intellectual Property

The Services, including all software, design, text, graphics, and branding, are the intellectual property of Southwest CRM Partners and are protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Services as described herein.

9. Availability and Support

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted access.
  • We may perform scheduled maintenance with reasonable advance notice.
  • Support is available via email during business hours, Monday through Friday, 9 AM–5 PM Pacific Time.
  • Priority support is available on Growth and Scale plans.

10. Limitation of Liability

To the maximum extent permitted by law, Southwest CRM Partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Services. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Southwest CRM Partners, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Services or violation of these Terms.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last updated” date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Clark County, Nevada.
